1. About Yummbak

Yummbak is a nutrition and symptom tracking tool currently in a structured beta phase with selected NZ dietitians, operating as a personal software project pending commercial launch (“Yummbak”, “we”, “us”). It is used by individuals tracking their own diet and gut health, and by registered dietitians and other health practitioners who invite clients to track on their behalf. By creating an account or using Yummbak, you agree to these Terms. If you do not agree, do not use the service.

2. Not Medical Advice

Yummbak is a tracking and information tool. It is not a medical device and does not provide medical, dietary, or clinical advice.

  • Nutritional estimates are approximations produced by AI and food composition databases — not laboratory-verified and not suitable for clinical decisions in isolation
  • Symptom and bowel movement logs are observational records, not diagnoses or clinical assessments
  • Nothing in Yummbak replaces the advice of your registered dietitian, doctor, or other qualified health professional
  • Always consult a qualified health professional before making changes to your diet, medication, or treatment plan

3. Practitioner Relationship

Yummbak provides software tools to registered dietitians, nutritionists, and other health practitioners (“Practitioners”) who use the platform to monitor their clients' nutrition and symptoms between consultations.

Yummbak is not a party to the clinical relationship between a Practitioner and their client. We are not responsible for:

  • The accuracy or appropriateness of clinical advice given by a Practitioner
  • Decisions a Practitioner makes based on data recorded in Yummbak
  • The outcome of any dietary or treatment plan prescribed by a Practitioner

Practitioners are solely responsible for:

  • Obtaining appropriate informed consent from clients before inviting them to Yummbak
  • Ensuring their use complies with the Dietitians Act 1950, the Health and Disability Commissioner Act 1994, the Health Information Privacy Code 2020, and where relevant the HISO 10029 Health Information Security Framework
  • Maintaining clinical records in accordance with their professional obligations (typically 10 years under NZ Dietitians Board requirements)

4. Eligibility and Account Registration

You must be 18 or older to create a Yummbak account independently. Clients under 18 may use Yummbak only when invited by a Practitioner who has obtained explicit consent from the client's parent or legal guardian. You are responsible for keeping your login credentials secure. You must not share your account with anyone else. You must provide accurate information when registering.

5. Your Data and AI Processing

You own your health data. By using Yummbak, you grant us a limited licence to store, process, and display your data for the purpose of providing the service to you.

  • AI processing: When you log a meal using a photo or description, that content is processed by Google's Gemini AI to identify foods and estimate nutritional content. Processing occurs in Google's Asia-Pacific region servers (Australia and Singapore). Yummbak uses the paid Gemini API. Under Google's paid API terms, Google does not use your prompts, photos, or data to train its models.
  • Aggregated data: We may use anonymised, aggregated usage data internally to improve the service. This data cannot be linked back to any individual. We do not share aggregated data with third parties without separate consent.
  • No sale of health data: We do not sell your health information to third parties and do not share it with advertisers.

6. Practitioner Access

If you join Yummbak via an invitation from a Practitioner, that Practitioner will have access to the following for the duration of your monitoring relationship. This access is disclosed at the time you accept the invitation.

  • Your meals, fluids, symptoms, and bowel movement logs
  • Your profile information (name, age, height, weight, dietary preferences)
  • Your daily and weekly nutrition totals and adherence patterns
  • Your logging activity (which days you logged, completeness of logs)

You may contact us at privacy@yummbak.com to request that a specific Practitioner's access be removed. Note that even after access is removed, a Practitioner may be required to retain a copy of your clinical records for up to 10 years to comply with their professional record-keeping obligations under NZ law.

7. Acceptable Use

You must not use Yummbak to:

  • Provide false information about your identity or health
  • Attempt to access another user's account or data
  • Reverse-engineer, scrape, or extract data from the platform
  • Use the service in any way that violates New Zealand law
  • Use nutrition data, food photos, or other content from Yummbak for academic research, AI training, or commercial purposes without our written permission

8. Data Retention and Deletion

We retain your data while your account is active. Accounts inactive for 24 months may be deleted after reasonable notice. You may request deletion at any time via the Delete Account option in app settings, or by emailing privacy@yummbak.com.

Upon deletion: your personal information (name, phone number, email) is permanently removed; health logs may be anonymised and retained for the minimum period required for Practitioner record-keeping obligations under NZ law; anonymised aggregated data may be retained indefinitely for service improvement purposes.

9. Termination by Yummbak

We reserve the right to suspend or terminate your account without notice if you breach these Terms, your account is used for fraudulent or illegal activity, or we are required to do so by law. If a Practitioner's account is terminated, the Practitioner will be given a reasonable window (minimum 30 days) to export their client records to fulfil their professional record-keeping obligations under NZ law.

10. Limitation of Liability

Yummbak is provided on an “as is” and “as available” basis. To the maximum extent permitted by New Zealand law, we exclude all liability for:

  • Indirect, incidental, or consequential loss or damage
  • Decisions made in reliance on Yummbak's nutritional estimates or AI output
  • Clinical outcomes arising from a Practitioner's use of the platform

Our total liability for any claim will not exceed NZD $100. Nothing in these Terms excludes liability that cannot be excluded under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

11. Privacy Breach Notification

In the event of a privacy breach that poses a serious risk of harm to affected individuals, we will notify affected users and the Office of the Privacy Commissioner in accordance with the NZ Privacy Act 2020.

12. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify you via the app or by email at least 14 days before they take effect. Continued use of Yummbak after the effective date constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand.
